That does look like a loophole. The whole idea about having different store is to take control away from them. If they still decide what can go in and what can not what is the point of side loading?
Apple was Mandated to allow different app stores, but you still need a valid signature in order to install those, so you still need an apple account, you still need to put in your full name, and you still need to pay them 100€\Year for the licence.
Also, Apple can still Revoke anyone’s signature if they don’t like your Apps.
EU mandated Apple to allow sideloading, can we have a state like California to mandate sideloading in it’s state? This is anticompetitive practice.

Even if they found a loophole, the loophole would be closed, otherwise apple would do the same.
